1. Principles
Your personal data will only be collected, processed and used in accordance
with the law and in good faith. As far as possible, we design our business
processes in such a way that the requirements for data protection are already
taken into account in the development of the products and service offerings and
that personal data is anonymized in such a way that the data subject cannot or
can no longer be identified if this does not jeopardize the agreed purpose.
MEDION uses your personal data, for the technical management and further
development of this website, for customer, user management and marketing, to
inform you about our services and products and for other well-defined purposes.
2. Sources and data used
In the course of our business relationships, we process personal data that we
have received directly from you. In addition, we process personal data that we
may legitimately obtain from publicly available sources or which are
legitimately transmitted to us by other third parties, insofar as this data is
necessary for the provision of the corresponding services and within the scope
of the agreed purpose. We store your data necessary for the processing of your
order, the use of our products or the delivery of services, such as repairs,
and – if selected by you – for the processing of payments. This is personal
data such as your address details, the date of birth (for transactions with age
verification) and data necessary for certain payment methods. The respective
order data (item, quantity, price, etc.) is assigned to your address data. In
most cases, MEDION is already legally obliged to collect this data (for
example, in the case of age verification in accordance with the Youth
Protection Act or the Tax Code).
3. Purpose of the processing and legal
bases The processing of
your personal data is carried out in accordance with the provisions of the
European General Data Protection Regulation (GDPR) and the Federal Data
Protection Act and also the country-specific regulations in North
Rhine-Westphalia:
In order to fulfil contractual obligations (Art. 6 sec. 1 b GDPR):
The processing of personal data takes place in the context of the trade in
products and services in the field of consumer electronics. The purposes of
data processing are primarily based on the specific product (e.B. physical or
digital) and its application possibilities or also on the order placed with us
(e.B. repair). Further details on data processing purposes can be found in the
contract documents, operating instructions and terms and conditions or terms of
use.
In the context of the balance of interests (Art. 6 sec. 1 f GDPR):
As far as necessary, we process your data beyond the actual fulfilment of the
contract in order to safeguard legitimate interests of us or third parties.
This includes the examination and optimization of needs analysis procedures for
direct customer contact, advertising or market and opinion research, insofar as
you have not objected to the use of your data for this purpose, the assertion
of legal claims and defense in the event of legal disputes, the guarantee of IT
security and OPERATIONS of MEDION, the prevention and investigation of criminal
offences due to official order, and the measures for the business management
and further development of MEDION services and products.
On the basis of your consent (Art. 6 sec. 1 a GDPR):
If we have your consent to the processing of personal data for certain purposes
(e.B. transfer of data in the group, evaluation of data for marketing
purposes), the legality of this processing is given on the basis of your
consent. The consent given can be revoked at any time. This also applies to the
revocation of declarations of consent given to us before the GDPR was applied,
i.e. before 25.05.2018. The revocation of consent does not affect the legality
of the data processed up to the revocation.
Due to legal requirements (Art. 6 sec. 1 c GDPR) or in the public interest
(Art. 6 sec. 1 e GDPR):
This includes, for example, identity and age verification or the fulfilment of
tax control and reporting obligations. Insofar as not presented below, no
personal data will be processed when using this website; that is, not stored or
modified or passed on to third parties.
4. Customer account
In order to provide you with the greatest possible comfort when making your
purchase, we offer you the permanent storage of your personal data in a
password-protected MEDION customer account for mediON's online offers. After
this customer account has been set up, no re-entry of your personal data is
required for the ordering process. If you already have an account for an online
offer at MEDION, the master data stored there will be transferred to your
MEDION customer account. Your MEDION customer account can henceforth be used
for ordering in the online offers at MEDION-, without the need for a separate
registration or re-disclosure of detailed user data. In addition, you can view
and change the data stored about you in your customer account at any time and
save .B items permanently for a later purchase. In addition to the data
requested when placing an order, you must provide a self-selected password to
set up a customer account. This is used together with your e-mail address for
access to your MEDION customer account. The legal basis for this is Article 6
paragraph 1 letter b) GDPR, i.e. you provide us with the data on the basis of
the contractual relationship between you and us. Your data will be passed on to
the operator of the respective offer for the processing of sales contracts or
other services commissioned by MEDION. The latter receives the data that is
required for the provision of the respective commissioned service, i.e.
verification of the log in data (e-mail address, password, if applicable
telephone number). We generally exclude any further disclosure of this data to
third parties. If you request the deletion of the MEDION customer account, your
data will be deleted accordingly. Furthermore, the processing and storage of
data is the responsibility of the respective operator of the used offer, who
uses the data that are necessary for the provision of the commissioned service
for this purpose and then archives them in accordance with the statutory
retention periods.
5. Customer Service
Personal data, which you provide to us when filling out contact forms, by
phone, by e-mail or via social media, we will of course treat confidentially.
We use your data only for a specific purpose to process your request. The legal
basis for data processing is Article 6 (1) (f) or Article 6 (1) (b) GDPR. Our
and your concodonent (legitimate) interest in this data processing results from
the aim of answering your enquiries, solving any problems that may arise and
thus to maintain and promote your satisfaction as a customer or user of our
website. If you participate in one of our customer surveys, this is done on a purely
voluntary basis. These anonymous surveys do not store any information that
allows conclusions to be drawn about the participants in the surveys. Only the
date and time of your participation will be saved. Any personal information you
provide during the response to our survey will be deemed to be voluntary and
stored in accordance with the GDPR. Please refrain from mentioning names or
similar in the free text boxes that allow conclusions to be drawn about you or
others. In the case of a declaration of consent in the context of a customer
survey, Article 6 (1) (a) GDPR is the legal basis for data processing based on
consent. If you have given your consents in the context of a customer survey,
you have the option to revoke these consents at any time with effect for the
future. In these cases, further details are regulated in the specific data
protection principles of the respective customer survey. Exceptionally, data is
processed on our behalf by processors in the field of customer service. These
are carefully selected, are also audited by us and contractually obliged in
accordance with Article 28 GDPR. If necessary to process your request, the data
you provide may be passed on to MEDION companies. Furthermore, it may be
necessary that we pass on extracts of your request to contractual partners
(e.g. suppliers for product-specific enquiries) for processing your request. In
these cases, the request will be anonymized beforehand, so that the third party
cannot establish any connection with you. If the disclosure of your personal
data is necessary in individual cases, we will inform you about this in advance
and obtain your consent. The results of our customer surveys are generally used
purely for internal evaluations. We will not pass on personal data to third
parties unless you have expressly consented to this. The results of our
customer surveys are generally used purely for internal evaluations. We will
not pass on personal data to third parties unless you have expressly consented
to this.
6. Transfer of data to third countries or
to international organisations
A transfer of data to entities outside the European Union (so-called third
countries) takes place insofar as it is necessary for the execution of your
orders, it is required by law or you have given us your consent. In addition,
MEDION does not transmit any personal data to agencies in third countries or
international organisations. However, MEDION uses service providers for certain
orders, which also use service providers who may have their registered office,
parent company or data centers in a third country. Under Article 45 of the
GDPR, transmission is permitted if the European Commission has decided that
there is an adequate level of protection in a third country. If such a decision
has not been taken, MEDION or the Service Provider may only transfer personal
data to a third country or to an international organisation provided for
appropriate safeguards (e..B standard data protection clauses adopted by the
Commission or the supervisory authority in a particular procedure) and
enforceable rights and effective remedies are available. MEDION has agreed
contracts with these service providers for so-called order processing, which
stipulate that their contractual partners always conclude basics for data
protection in compliance with the European data protection level.
7. Storage periods
MEDION processes and stores your personal data as long as this is necessary for
the fulfilment of our contractual and legal obligations. If the data is no longer
necessary for the fulfilment of contractual or statutory obligations, they are
regularly deleted, unless their – temporary – further processing is required
for the following purposes: preservation of evidence within the scope of the
statutory statute of limitations. According to Sections 195 et seq. of the
Civil Code (BGB), these limitation periods can be up to 30 years, with a
regular limitation period of three years. Furthermore, this includes the
fulfilment of commercial and tax retention obligations in accordance with the
German Commercial Code (HGB) or the Tax Code (AO). The retention or
documentation deadlines set out in the aforementioned laws are two to ten
years.
8. Your data subjects
Any person affected by the processing of personal data has the right
to:information ( Section 34 OF the BDSG, Art. 15 GDPR), correction (Art. 16
GDPR), deletion ( Section 35 BDSG, Art. 17 GDPR), restriction of processing
(Art. 18 GDPR), data portability (Art. 20 GDPR) and GMO objection ( Article 21
GDPR). However, restrictions apply to the right of information and cancellation
under Sections 34 and 35 of the German Federal Data Protection Act (Article 23
OF the GDPR), and there is also a right of appeal to a competent data
protection supervisory authority (Art. 77 GDPR i. V.m. Section 19 of the GERMAN
Federal Data Protection Act). For MEDION, this is the State Commissioner for
Data Protection and Freedom of Information North Rhine-Westphalia, P.O. Box
200444, 40212 Düsseldorf.

9. Obligation to provide data In the
context of
our business relationship, you must provide the personal data necessary for the
establishment and execution of a business relationship and the fulfilment of
the associated contractual obligations or which we are legally obliged to
collect. Without this information, we will generally not be able to enter into
or execute the contract with you or the enforcement of your legal rights (e..B
guarantees and warranties) is at risk.
10. Automated decision-making and
profiling
In order to establish and execute the business relationship, we do not
generally use fully automated decision-making in accordance with Article 22
GDPR. If we use these procedures in individual cases, we will inform you about
this separately, if this is required by law. We process some of your data
automatically with the aim of evaluating certain personal aspects (profiling).
We use profiling e.B. in order to be able to inform you about products and
services in a targeted manner or we use evaluation tools. These enable
needs-based communication and advertising, including market and opinion
research.
11. Onsite targeting and website
optimization
On our website, information on the optimization of our websites and the
advertisements displayed on it is collected and evaluated using cookies. In
particular, this is to ensure that, based on your previous usage behaviour, you
will only see advertisements based on your actual or alleged interests on your
terminal devices. The information processed for these purposes contains, for
example, information about which of our products you are interested in. The
legal basis for this data processing is Article 6 (1) (f) GDPR. The
optimization of our websites for a better shopping experience and the avoidance
of advertisements that are not of interest to you is in your interest as well
as in our interest. The recording and evaluation is exclusively pseudonymous
and does not allow us to identify you directly. In particular, the information
will not be merged with your other personal data. We use AB TASTY's web
analytics service AB TASTY SAS, 3 impasse de la Planchette, F-75003 Paris
("AB Tasty") to perform A/B or multivariate tests to continuously
improve our online offering. AB Tasty collects statistical information about
visitor access. This information is usage data (used browser, number of pages
viewed, number of visits, order of visit, duration of visit, interactive actions
such as filling/emptying a shopping cart, recording of the use of individual
websites (except in the check-out and the "My MEDION" area) etc.)
which are recorded anonymously and statistically evaluated. It is not possible
to inference a specific person or an individual purchase at any time. In
addition, AB Tasty uses your IP address to geolocation (regional details of
your location). After geolocation, which occurs immediately when you visit the
site, your IP address will be deleted immediately. A personalized pattern is
created to display content that meets your interests. This pattern is encrypted
and does not allow conclusions to be drawn about yourself. Cookies are stored
for the storage and recognition of page visitors. These have a maximum term of 13
months and are then automatically deleted. You can also delete the cookies
manually or prevent them from being stored in the future. An opt-out cookie is set via the
link https://www.medion.com/de/shop/#abtastyoptout=1, which
prevents future storage. If you delete your browser cookies, a new opt-out via
this link is necessary. We would like to point out that with an opt-out, some
functions of the website are not available or are only available to a limited
extent. Recipients of the data are the service providers highlighted above, who
process your data on a contractual basis purely for a specific purpose
according to our instructions. The cookies used here and the information
contained therein are stored in accordance with the cookie regulations and
deleted immediately upon objection.

Cookies
In addition to the aforementioned data, cookies are stored on your computer
when you use our website. Cookies are small text files that are stored on your
hard drive as associated with the browser you are using and through which
certain information flows to the place that sets the cookie (here through us).
This is used, for example, to analyse the performance of the website through
cookies, which help to improve our website by providing us with aggregate
statistics on the number of visitors to a page, which areas of a site are
viewed the most and the city or location of users. These can be installed by
external analysis providers commissioned by us. These cookies do not personally
identify you. Cookies cannot run programs or transmit viruses to your computer.
They only serve to make the Internet offer more user-friendly and effective
overall. MEDION uses the following types of cookies: Transient Cookies and
Persistent Cookies. Transient cookies are automatically deleted when you close
the browser. This includes, in particular, session cookies. These store a
so-called session ID, which can be used to assign various requests from your
browser to the common session. This allows your computer to be recognized when
you return to our website. Session cookies are deleted when you log out or
close the browser. Persistent cookies are automatically deleted after a
predetermined duration, which may vary depending on the cookie. You can delete
the cookies in your browser's security settings at any time. You can configure
your browser setting according to your wishes and, for example.B refuse to
accept third-party cookies or all cookies. Please note that you may not be able
to use all the features of this website. Please note that most browsers offer
different ways to protect your privacy. You can allow e.B. first-party cookies,
but block third-party cookies or be notified each time a website wants to
install a cookie. Please note that such a deactivation of cookies will prevent
the setting of new cookies. However, it does not prevent previously set cookies
from continuing to work on your device until you have deleted all cookies in
your browser settings. The instructions for managing cookies on your browser
can usually be found under the help function of the browser or in the user
manual of your smartphone or the used stationary or mobile product with
internet access. In addition, we use cookies to identify you for subsequent
visits if you have an account or a separate individual access to our offers.
Otherwise, you would need to log in again for each visit. The Flash cookies
used are not collected by your browser, but by your flash plug-in. Furthermore,
we use so-called HTML5 storage objects, which are stored on your device. These
objects store the required data independently of your browser and do not have
an automatic expiration date. If you do not want to process Flash cookies, you
must install an add-on, for example for Mozilla Firefox or the Adobe Flash
Killer cookie for Google Chrome. You can prevent the use of HTML5 storage
objects by using private mode in your browser.

Webtrekk
We use on the basis of our legitimate interests (i.e. interest in the
analysis, optimization and economic operation of our online offer within the
meaning of Art. Lit. f. GDPR) the marketing services (short "Webtrekk
services") of the Webtrekk GmbH, Robert-Koch-Platz 4, 10115 Berlin
("Webtrekk"). Webtrekk has its registered office in Germany.
This company is thus subject to the scope of application of German and European
data protection law. It has been certified for data protection in the area of
web controlling in Germany, after its data processing has been checked for data
protection compliance and data security.
Webtrekk creates user profiles for the purposes of advertising, market research
or for the needs-based design of offers using pseudonyms, unless you object to
this. The user profiles are created via so-called cookies. These cookies have

Medion AG that his data will be processed without this pseudonymization and the
user identifies himself via our website, we will bring this data and the master
data stored with us together and transmit them encrypted (more precisely:
gehashed) to Webtrekk. An identification of the user's person by Webtrekk is
not possible. However, this comparison allows us to define specific user groups
(e.B. to establish a connection between interest in our products and age) and
thus to address user groups with targeted advertising measures within the scope
of their interests.
